Operator

Who Tack is for
Tack is a service for businesses and organisations. By signing up you confirm that you use it for your business or for the organisation you act for.
Early access
Tack is in early access. Features and limits may change, and we may pause accounts that harm the service or other people.
Your account
Keep your sign-in methods safe. You are responsible for what happens in your workspaces and for the people you invite.
Credits and payments
Tests and pins are paid with credits that you buy in advance; one credit launches a test or a pin, and where the app offers a monthly free credit, you can use it when you have no bought credits left, with the smaller scope shown in the app; current prices are shown in the app before you pay. Prices are final and include VAT; you pay in Czech crowns or euros, whichever you choose when buying. A credit is used when a test or pin is published, within the scope shown in the app (completed sessions for a test, time and answers for a pin). Credits given for free, for example from the waitlist or as a trial, cannot be exchanged for money. Paid credits are not refunded unless the service did not work through our fault or the law requires it. We send you a tax invoice by e-mail for every paid order. The details for it, your billing address and for companies the company or VAT ID, are entered at payment.
Your content and data
Tests, pins and results belong to you. You give us permission to process them only to provide the service. Tack's software, design and brand remain ours.
Processing personal data for customers
For data of respondents and visitors of your sites, you are the controller and we are your processor under Article 28 GDPR; this section is our data processing agreement. We process the data the script collects according to your tests and pins (see the Privacy policy), for as long as you use the service, only on your instructions and only to provide the service. We keep it confidential and reasonably secure, and use only the processors listed in the Privacy policy; we tell you about changes in advance and you may object. We help you handle respondents' requests and inform you of a personal data breach without undue delay. We delete the data after the retention period or when the account is closed, and on request provide the information needed to show we meet these obligations. If you need a signed data processing agreement, write to us.
Your obligations
Install the script only on sites you operate or are allowed to. Inform respondents and visitors about the data collection and have a legal basis for it; where consent is needed, use the pin option Show only after consent. Do not use Tack to collect sensitive data, to track people without informing them, or to attack or overload other systems.
The trytack.io website
We measure visits to the website only with your consent. The privacy policy describes what is collected, how long we keep it and how to withdraw consent.
Ending
You can delete your account at any time in Settings → Account. It is deleted at once, along with workspaces where you are the only member, except data we must keep by law (orders). If you are the only owner of a workspace with other members, hand ownership over first. We may pause or close an account for a serious breach of these terms.
Liability
The service is provided as is during early access. We do our best to keep it available and your data safe, but we cannot guarantee uninterrupted operation. Our total liability is limited to the amount you paid us in the last 12 months, unless the law provides otherwise.
Changes to the terms
We may change these terms. We tell you about material changes by e-mail at least 14 days in advance; if you do not agree, you can close your account.
Governing law
These terms are governed by the law of the Czech Republic. Disputes will be resolved by Czech courts.
